The Legal Process of Egg Donation: What Donors Need to Know

Many people are able to realize their family building goals through egg donor services. Egg donors enter into a a legal service agreement with their recipients of their eggs, whereby their eggs can be frozen or used fresh for family building. The reason that legal service agreements are drawn up is because egg donors do not have any rights or responsibilities over the children born from their eggs. So let us address the legal considerations of egg donation.

Contracts & Legal Agreements

State laws regulate fertility treatments and these laws vary from one State to another. Therefore, an egg donor needs to familiarize themselves with the laws governing egg donation in the State where they live. Contracts between egg donors and recipients are vital to ensure that each party understands their roles and responsibilities, which helps the process to move smoothly.

The roles and responsibilities of the egg donor agency, covering the medical aspects of egg donation, are included. The duration, insurance, legal fees, medical costs incurred, allowances, compensation and payout timeline for egg donors are also outlined. The date, time and location of egg retrieval, legal custodianship of the child, present or future contact (or anonymity) between egg donors and recipient families are also clearly stated.

As one can see, there is a lot of detail included when hashing out the terms of engagement for egg donors and recipients. No medical process can begin if the egg donor contract is not signed. While fertility clinics tend to have a standard agreement, each egg donor-recipient circumstance is different, so egg donors are advised to seek legal counsel before signing.

Parental Rights & Anonymity

Without a contract in place, parental rights, donor-recipient contact or anonymity, and future disputes may be difficult to resolve. Even if the egg donor is biologically related to the child born, or even the recipient of their eggs, they have no parental rights toward the child. Recipients will typically decide if they want any contact with the egg donor. This is determined in three options; completely anonymous, semi-anonymous or open donation.

Open donation could be in the case where the recipient may be related to the donor (a sister, aunt, cousin), in which case they know each other. Open donation could also be where the donor and recipient are strangers but the recipient would like to know who their donor is. A semi-anonymous donation could be where recipients are open to knowing the donor at a future time, or would like the option of allowing the child to seek out their egg donor. A completely anonymous donation is structured such that even medical records do not have any identifying information on them. In such a case, the records would be filed under codes, or numbers.

What Happens in Case of Future Medical Issues?

Future medical issues can arise with the egg donor or the child born from their donation. For the egg donor, the side-effects and potential risks of egg donation are discussed prior to the start of the process. As well, medical insurance is given to egg donors to cover them during the egg donor process. In the event that there is a dispute, the egg donor contract outlines the steps to take to resolve the matters arising.

There are circumstances whereby children born from egg donation may require medical attention which would involve the egg donor. Some countries have agreements allowing professional medical practitioners to use best practices in intervening medical conditions while honoring the anonymity clauses in place.

Conclusion

While egg donation is done voluntarily, and has many benefits, the nature of egg donation is such that the process would not go smoothly without proper legal agreements in place. Therefore egg donors are advised to carefully consider the process, its side-effects, potential risks, the extent of their role and responsibilities, besides the compensation package. This can be done with the help of professional legal counsel so that any aspects that are not clear may be clarified before the egg donor signs the contract and begins the process.
